Overview:
This Litigation Department position serves as internal coverage and extra-contractual counsel to AmTrust’s nationwide claims organization. In this role, you will provide consultation, critical analysis and strategic development recommendations relative to the most complex and challenging claims circumstances across all AmTrust business lines and jurisdictions.

Internal coverage counsel services AmTrust’s U.S based, specialty, core and workers compensation claims organizations with coverage determinations and mitigating extra-contractual risks. Day-to-day responsibilities will include providing advice to claims adjusters by way of reviewing proposed coverage position letters drafted by adjusters, responding to coverage questions from the claims organization, performing legal research, and formulating strategy on litigated coverage and bad faith matters with claim adjusters and managers to obtain optimal resolution. You will also monitor and handle a small pending of extra-contractual matters.

This position may be remote, or reside in any AmTrust claims office, if desired (subject to space constraints). Occasional travel may be required.

Responsibilities:
Responsibilities include:
  • Providing coverage analysis, including conclusions and recommendations for coverage issues and claims handling relative to bad faith and extra-contractual exposure;
  • Giving guidance on additional investigation that may be required to resolve coverage and extra-contractual concerns;
  • Succinctly presenting complex issues to upper management in the Claim, Litigation and Underwriting Departments;
  • Communicating with Company stakeholders in Underwriting, Regulatory, Audit and Corporate Legal;
  • Working with outside counsel to formulate proactive litigation and pre-suit strategies:
  • Direct and manage case strategy and budget;
  • Comment upon and approve pleadings and motion papers;
  • Assist with deposition preparation and custodian interviews;
  • Assist with internal investigations relative to extra-contractual and bad faith matters.
  • Assisting with litigation holds and ESI collections; and
  • Developing and analyzing broad claims, underwriting and litigation data with a focus on isolating areas of concern and improvement.

Qualifications:
Qualifications:
  • JD American Bar Association accredited law school;
  • 3+ years liability coverage experience (in-house or law firm);
  • Understanding of national coverage and extra contractual/bad faith law;
  • West Coast/Southwest experience preferred but not required;
  • Ability to track down information and navigate large company with minimal guidance;
  • Excellent oral and written communication skills; and
  • Basic Excel skills.
